  • Social Scoring: AI systems used by public authorities, or on their behalf, for the evaluation or classification of natural persons based on their social behaviour or personal characteristics, which leads to detrimental or unfavourable treatment. This prohibition aims to prevent the emergence of surveillance capitalism and systems akin to China’s social credit system, which undermine individual freedoms and social cohesion.
  • Real-Time Remote Biometric Identification in Publicly Accessible Spaces: The use of AI systems for real-time remote biometric identification (e.g., facial recognition, gait analysis) in publicly accessible spaces for law enforcement purposes is generally prohibited. This is a particularly sensitive area due to its profound implications for privacy and surveillance.   1. AI systems intended to be used as a safety component of products already covered by existing EU harmonisation legislation. This includes critical product safety legislation such as the Medical Devices Regulation (MDR), Machinery Directive, Toy Safety Directive, and Aviation Safety Regulations. For instance, AI used in medical devices, autonomous vehicles, or industrial robots falls under this category, inheriting the high-risk classification from the product it serves. The AI Act aims to complement, not replace, these sector-specific regulations, adding an AI-specific layer of conformity assessment.

    • Critical Infrastructure: AI systems used as safety components in the management and operation of road traffic, water, gas, heating, and electricity supply, or for the dispatching of emergency services, where their failure or incorrect functioning could put the life and health of persons at risk.
    • Education and Vocational Training: AI systems intended to be used for determining access or for the evaluation of learning outcomes of persons, particularly for assessing student performance, or influencing educational or professional trajectories. This aims to prevent algorithmic bias in educational opportunities.
    • Employment, Worker Management, and Access to Self-Employment: AI systems intended to be used for recruitment or selection procedures (e.g., resume filtering, emotion recognition in interviews), for making decisions on promotion or termination, or for monitoring workers. The goal is to prevent discriminatory hiring practices or unfair surveillance.
    • Access to and Enjoyment of Essential Private Services and Public Services: AI systems intended to be used for evaluating the creditworthiness of natural persons or establishing their credit score (excluding fraud detection), or for dispatching or prioritising emergency services. This category includes systems that determine eligibility for public assistance benefits or health services.
    • Law Enforcement: AI systems used for individual risk assessments, polygraphs, or for evaluating the reliability of evidence in criminal proceedings. It also covers systems for predicting the occurrence of a crime or identifying crime patterns, subject to strict safeguards.
    • Migration, Asylum, and Border Control Management: AI systems used for assessing the eligibility of individuals for asylum, visa, or residence permits, for detecting illegally crossing borders, or for verifying travel documents.
    • Administration of Justice and Democratic Processes: AI systems intended to assist judicial authorities in researching and interpreting facts and the law, or in applying the law to a concrete set of facts. This excludes purely ancillary administrative or research systems that do not directly influence judicial decisions.

For high-risk AI systems, the compliance obligations are extensive and cover the entire lifecycle of the AI system, from design and development to deployment and post-market monitoring. These obligations are articulated across various chapters of the Act:

  • Risk Management System (RMS): Providers of high-risk AI systems must establish, implement, document, and maintain a robust RMS. This is a continuous iterative process throughout the entire lifecycle of the AI system, involving identifying, analysing, evaluating, and mitigating risks. It requires a systematic approach to risk reduction, taking into account foreseeability of misuse and potential harms. The RMS must be integrated into the provider’s quality management system.
  • Data Governance and Data Quality: High-risk AI systems rely heavily on data, making data governance paramount. Providers must implement rigorous data governance practices, ensuring the quality, relevance, representativeness, completeness, and error-freeness of datasets used for training, validation, and testing. Special attention must be paid to mitigating bias in data, especially for sensitive attributes, to prevent discriminatory outcomes. Adherence to data protection regulations like the GDPR is crucial, particularly concerning the processing of personal and sensitive data.
  • Technical Documentation: Comprehensive and meticulous technical documentation is required for all high-risk AI systems. This documentation must demonstrate compliance with the Act’s requirements and include detailed information on the system’s design, development, training data, testing procedures, performance characteristics, and the risk management system in place. It serves as a crucial record for market surveillance authorities.
  • Record-keeping (Logging Capabilities): High-risk AI systems must be designed and developed with logging capabilities to automatically record events over their lifetime. These logs are essential for enabling the monitoring of the system’s operation, checking its compliance with the Act, and facilitating ex-post analysis in case of incidents or malfunctions. Logs must be accessible to relevant authorities.
  • Transparency and Provision of Information to Users: Providers must ensure high-risk AI systems are sufficiently transparent to enable deployers to interpret the system’s output and use it appropriately. This includes providing clear, comprehensive, and understandable information about the system’s capabilities, limitations, intended purpose, known risks, level of accuracy, and the human oversight measures implemented. The information should be accessible to users and stakeholders, fostering trust and accountability.
  • Human Oversight: High-risk AI systems must be designed to allow for effective human oversight. This means humans must be able to intervene in, prevent, or override the system’s decisions, especially in critical situations. The Act requires that humans have the capability to meaningfully review and control the AI system, prevent or minimise automation bias, and be able to interpret the system’s output. The degree of human involvement can vary (e.g., human-in-the-loop, human-on-the-loop, human-in-command) depending on the context and criticality.
  • Robustness, Accuracy, and Cybersecurity: High-risk AI systems must be designed and developed to achieve an appropriate level of accuracy, robustness, and cybersecurity. Robustness implies resilience against errors, faults, and unforeseen situations, including external interference or adversarial attacks. Accuracy refers to the system’s ability to correctly perform its intended function. Cybersecurity measures are vital to protect AI systems from malicious attacks that could compromise their integrity, data, or performance, leading to safety risks or fundamental rights violations.
  • Conformity Assessment: Before being placed on the market or put into service, high-risk AI systems must undergo a conformity assessment procedure to demonstrate compliance with all the requirements of the Act. For most high-risk systems, this involves third-party conformity assessment by a ‘notified body’ – an independent organisation designated by Member States to perform such tasks. For some high-risk systems (e.g., those already covered by existing product safety legislation), self-assessment might be permitted, but under strict conditions. Successful conformity assessment leads to the affixing of the CE mark.
  • Quality Management System (QMS): Providers must implement a robust QMS that covers all aspects of the design, development, testing, deployment, and monitoring of their AI systems.   • Reporting of Serious Incidents and Malfunctions: Providers must establish procedures for reporting serious incidents or malfunctions that lead to harm or a significant risk of harm to health, safety, or fundamental rights to relevant national market surveillance authorities without undue delay. This allows for prompt investigation and corrective measures.

3.3 Limited Risk

AI systems classified under the limited risk category are subject to specific transparency obligations, reflecting their lower potential for harm but acknowledging the importance of user awareness and autonomy. The primary requirement is to inform users that they are interacting with or exposed to an AI system. This transparency aims to promote trust and clarity in AI-human interactions, allowing individuals to make informed decisions about their engagement with AI.

Key examples include:

  • AI systems intended to interact with natural persons: Chatbots, virtual assistants, or similar conversational AI must clearly inform users that they are interacting with an AI system, rather than a human. This prevents deception and allows users to adjust their expectations accordingly.
  • Emotion Recognition and Biometric Categorisation Systems: AI systems that recognise emotions or categorise individuals based on biometric data (e.g., inferring gender, age, or ethnicity) must inform the individuals present about the system’s operation. This empowers individuals to decide whether they wish to engage with or be subjected to such systems, safeguarding their privacy and autonomy.
  • Deepfakes and Other AI-Generated Content: AI systems that generate or manipulate image, audio, or video content (deepfakes) that appreciably resembles existing persons, objects, places, or events, and that would falsely appear to a person to be authentic, must disclose that the content has been artificially generated or manipulated. 4. Compliance Requirements and Implementation Timelines

4.1 Compliance Obligations

  • Providers: The primary duty-holders under the Act. A provider is any natural or legal person, public authority, agency, or other body that develops an AI system or that has an AI system developed and places it on the market or puts it into service under its own name or trademark. Providers of high-risk AI systems bear the most extensive obligations, including establishing a QMS, conducting conformity assessments, implementing risk management, and ensuring data governance, logging, human oversight, robustness, accuracy, and cybersecurity. They are also responsible for post-market monitoring and serious incident reporting.
  • Deployers (Users): Any natural or legal person, public authority, agency, or other body using an AI system under its authority. Deployers of high-risk AI systems have specific obligations, such as ensuring human oversight, monitoring the system’s operation, understanding its capabilities and limitations, using the system in accordance with its instructions, and keeping logs. They must also inform individuals about the use of high-risk AI systems where relevant and cooperate with market surveillance authorities.
  • Importers: Any natural or legal person established in the Union who places an AI system that has been developed outside the Union on the Union market. Importers must ensure that the AI system complies with the Act and that the provider has fulfilled its obligations. They must verify the conformity assessment procedure has been carried out and that the system bears the CE mark.
  • Distributors: Any natural or legal person in the supply chain, other than the provider or importer, who makes an AI system available on the market. Distributors must act with due care regarding the requirements applicable to AI systems, ensuring they do not supply non-compliant systems.

Governance and Enforcement:

The Act establishes a multi-layered governance structure to ensure effective implementation and enforcement:

  • National Competent Authorities: Member States are required to designate national competent authorities responsible for the implementation and enforcement of the Act at the national level. These authorities will oversee market surveillance activities, conduct investigations, and impose penalties for non-compliance.
  • Market Surveillance Authorities: These national bodies are tasked with supervising the AI systems on the market, performing checks, and taking corrective action when non-compliant systems are identified.     • For non-compliance with other requirements for high-risk AI systems (e.g., data governance, risk management, human oversight), fines can be up to €15 million or 3% of the total worldwide annual turnover.
    • For supplying incorrect, incomplete, or misleading information to notified bodies, fines can be up to €7.5 million or 1% of the total worldwide annual turnover.

4.2 Implementation Timelines

The AI Act outlines a phased implementation approach, recognising the complexity of the regulation and the need for a realistic transition period for stakeholders to adapt their practices and systems. This staggered timeline aims to provide sufficient time for organisations to achieve compliance, particularly for the more intricate high-risk requirements:

  • August 1, 2024: The date the AI Act formally entered into force. From this date, the provisions related to governance, setting up of national authorities, and the European AI Board began to apply, initiating the foundational work for the Act’s full implementation.
  • February 2, 2025 (6 months after entry into force): Provisions related to prohibited AI practices become applicable. This means that from this date, the development, placing on the market, or putting into service of any AI systems deemed to pose an unacceptable risk (e.g., social scoring, real-time remote biometric identification with narrow exceptions) will be illegal. This short timeline reflects the immediate priority of preventing the most egregious and harmful AI uses.
  • August 2, 2025 (12 months after entry into force): Regulations concerning General Purpose AI (GPAI) models, including foundation models, come into effect. The longer timeline for this category reflects its lower priority compared to high-risk systems and prohibited practices, allowing ample time for the development of appropriate transparency mechanisms.
