California Curbs AI in Healthcare: A New Era in Coverage Decisions

As artificial intelligence (AI) continues to infiltrate various sectors, the healthcare industry finds itself at a pivotal juncture. The potential advantages of AI are substantial, ranging from enhanced diagnostic accuracy to the simplification of administrative procedures. However, the incorporation of AI into healthcare decision-making also introduces notable ethical and practical dilemmas. Recognising these complexities, California has enacted the Physicians Make Decisions Act (SB 1120), a groundbreaking piece of legislation aimed at regulating AI utilisation by health insurers.

Scheduled to come into force on January 1, 2025, California’s new law signifies a crucial intervention in the deployment of AI for healthcare coverage decisions. The statute stipulates that determinations regarding medical necessity and prior authorisation must be executed by licensed healthcare professionals, rather than AI algorithms. This requirement highlights the significance of preserving human oversight in medical decision-making, ensuring that AI functions as an auxiliary tool rather than a surrogate for human judgement. A coalition of physician organisations, medical groups, and patient advocacy groups advocated for the law, reflecting widespread apprehension about AI’s potential to introduce biases and inaccuracies into healthcare.
